GoHighLevel Compliance: Texting, Email, Calls and HIPAA Guide

Quick answer

GoHighLevel compliance is the set of legal and carrier rules you are responsible for when you use the platform: A2P 10DLC or toll-free registration for texts, consent and opt-out rules, quiet hours, call recording consent, email rules such as CAN-SPAM and GDPR, and HIPAA for health data. HighLevel supplies tools for each. You supply the consent, the wording and the decisions. This is not legal advice.

Key takeaways

  • GoHighLevel compliance has six areas: carrier registration, consent and opt-out, quiet hours, call recording, email rules and health data. HighLevel provides tools in each. Consent, wording and legal judgment stay with you.
  • US business texts from a local number need A2P 10DLC registration. HighLevel's fee article, checked 2026-10-13, lists a one-time bundle of $22.50 or $64 and a monthly campaign fee of $1.50 to $10. Toll-free numbers use a separate verification instead.
  • HIPAA is an opt-in add-on at US$297 a month that must also be switched on in each sub-account by hand. It covers data inside HighLevel, not data your workflows send elsewhere.
  • The FCC adopted revised TCPA revocation rules on September 30, 2026 (FCC 26-67). They take effect 30 days after Federal Register publication, which we could not confirm. Keep honoring STOP immediately until you have read the FCC public notice.
  • Email needs an unsubscribe link, a postal address and honored opt-outs within 10 business days (FTC). HighLevel's unsubscribe link is a setting, and the address is text you type into the footer.

What is GoHighLevel compliance?

GoHighLevel compliance is the set of rules you must follow, and the platform settings that help you follow them, when you text, call, email or store data in a HighLevel account. HighLevel registers numbers, adds opt-out wording, blocks sends to contacts on Do Not Disturb, holds messages inside a time window, adds unsubscribe links and offers a HIPAA package. It does not collect consent, choose your message wording, decide whether a message is marketing or informational, or make your agency compliant. Those are the sender’s job. This guide routes you to the page that handles each.

This is not legal advice. It explains what the rules and HighLevel’s documentation say, checked on 2026-10-13. For edge cases, such as whether a message counts as marketing, how state rules apply to your business or how to word consent, ask a lawyer who handles telecom, privacy or healthcare law for your situation.

How does GoHighLevel compliance fit together?

Think of it as five layers. A message has to clear each layer before it reaches a person, and different parties own each layer.

Layers a message passes through

  1. Carrier layer. Numbers are registered (A2P 10DLC) or verified (toll-free). Owner: you file, carriers and registries approve.
  2. Consent layer. The person agreed, and you can prove it. Owner: you.
  3. Contact-rules layer. STOP/Do Not Disturb, quiet hours, state rules. Owner: HighLevel provides the settings, you configure them.
  4. Content layer. Opt-out wording, sender identity, address in email, recording notices. Owner: you.
  5. Data layer. HIPAA, GDPR, where and how data is stored and shared. Owner: shared; HighLevel is the processor or business associate, you are the controller or covered entity’s vendor.

A failure at any layer shows up differently. A carrier failure is a blocked or filtered text. A consent failure shows up later, in a complaint or lawsuit. A data failure shows up in an audit or a breach.

Which rule applies to me?

Find the thing you do in the first column. Where the rule is a legal question, the right-hand column tells you to ask counsel.

If you… The rule or requirement HighLevel’s part Read
Text US customers from a local number A2P 10DLC brand and campaign registration (carriers) Trust Center flow, fees passed through A2P registration steps

Hold patient information HIPAA: BAA chain, safeguards HIPAA package and BAA; per-sub-account toggle HIPAA setup

Rows can stack. A dental practice in Texas that texts patients, records calls and emails reminders sits in at least five of them. The GoHighLevel for medical clinics page shows how those combine.

What is HighLevel responsible for, and what are you responsible for?

The split is consistent across areas: HighLevel builds the control, you decide how to use it and you keep the evidence.

Area HighLevel provides You are responsible for
Carrier registration Trust Center flow, AI compliance check before submission, fee pass-through Accurate legal name and EIN, a public website, consent flow that matches the campaign, fixing rejections

How do I register my numbers for texting?

Register before you send. A2P 10DLC registration has two parts: a Brand (who you are) and a Campaign (what you send and how people opt in). The walkthrough in GoHighLevel A2P registration steps covers the Trust Center path, the fields reviewers cross-check, sample messages, opt-in proof and fees. If you are already rejected, use why registrations get rejected. If you are waiting, how long approval takes breaks the wait into brand, campaign and carrier sync. Toll-free numbers skip A2P but have their own wait; see texting from a toll-free number. The A2P fee calculator adds up the one-time and monthly costs, and the SMS error code guide decodes what a failure means.

Capture written consent with an unchecked checkbox, keep proof, let HighLevel add opt-out wording, honor STOP through Do Not Disturb, and put a Time Window on marketing workflows. GoHighLevel TCPA setup has the menu paths, the table of what the federal rule text says and a seven-point pre-campaign check.

One live issue: on September 30, 2026 the FCC adopted FCC 26-67, which revises its consent-revocation rules, and released it on October 1. The order takes effect 30 days after Federal Register publication, and we could not confirm when that is. The page separates what the FCC’s text says from what law-firm summaries say. Until you have read the FCC’s public notice, keep honoring every STOP reply at once.

State rules add a second layer. The texting and call recording laws by state table compares 18 states on text coverage, quiet hours, recording consent, registrations and lawsuits. Several have state pages that explain how the build changes there: Texas, Florida, California, Washington, Maryland, Oklahoma and Virginia, among others in the GoHighLevel expert directory. Use the strictest window among the states you send to, or segment by state.

Can I record calls in GoHighLevel?

Yes, if you meet the consent rule in each party’s state. Federal law needs one party’s consent, but a dozen or so states need every party to agree. Is it legal to record calls in GoHighLevel? explains the disclaimer feature, and the state table lists the rule for 18 states. A disclaimer that plays before the call connects is the usual way to get everyone’s consent. Recording usage is billed per minute, so see the pricing calculator if you record at volume.

If calls are being labelled as spam, that is a carrier reputation issue rather than a recording issue: see why calls show Spam Likely.

How do I keep email compliant?

Use the unsubscribe link, type your postal address into the footer, make header details honest, label ads, and honor opt-outs. GoHighLevel CAN-SPAM setup gives the Business Profile toggle, the unsubscribe tag, the footer caveat, the List-Unsubscribe header and the GDPR points that touch email. Deliverability and legal compliance overlap at domain authentication: SPF, DKIM and DMARC covers the DNS side. If sending has been blocked, read HighLevel’s email suspension rules and why sending was suspended. Cold email carries extra risk: see can you send cold emails with GoHighLevel.

What about GDPR and HIPAA?

GDPR and HIPAA are data rules, not messaging rules, and each has a platform piece and a part that is yours. For GDPR, Is GoHighLevel GDPR compliant? explains the processor and controller roles, the DPA, US hosting, the cookie banner and deletion requests. For HIPAA, Is GoHighLevel HIPAA compliant? answers the yes-or-no question and the BAA chain, and GoHighLevel HIPAA setup is the order of work: buy the package, sign the BAA, switch on each sub-account, then audit workflows, forms and texts. HighLevel’s article calls agency-level activation automatic and sub-account activation manual, which is the step most setups miss. Clinics and dental practices will also want GoHighLevel for medical clinics and the dental practices page.

What should I check first?

Run this short list on any account before you scale sends. It takes under an hour and catches the common failures.

  1. Registration. Each sending number shows A2P Verified, or a verified toll-free status.
  2. Consent. Each phone and email form has an unchecked consent box, and the wording matches your campaign.
  3. STOP test. Reply STOP from a test phone and check the contact turns on SMS DND.
  4. Time windows. Marketing workflows have a Time Window in the contact’s time zone.
  5. Email footer. Unsubscribe link once, postal address in the rendered footer.
  6. Recording. A disclaimer plays where you record calls.
  7. Data. For health data, the HIPAA toggle is on in each relevant sub-account and no workflow sends PHI to an unsigned tool. For EU and UK contacts, the cookie banner is on and the privacy notice names HighLevel.
  8. Records. Keep screenshots and exports of consent wording and settings with dates.

If something fails, the support troubleshooting hub routes by symptom, and the setup guide shows where compliance fits in the build order.

Who can help me set this up?

If you want the checks built and tested rather than done by hand, aibrevo’s GoHighLevel implementation service includes registration filing, consent forms, workflow time windows and email setup. Scope decides the price; see pricing or send a message. To compare providers first, the GoHighLevel expert hub explains what to ask. Legal review of consent wording and state rules stays with your counsel.

Non-US numbers need regulatory bundles, Australian local numbers need an approved business bundle from July 1, 2026, and alphanumeric sender IDs aren't supported natively.

GoHighLevel is not HIPAA compliant by default. • Can I Text From a GoHighLevel Toll-Free Number Right Away? FAQ
No. A GoHighLevel toll-free number cannot send SMS or MMS until it passes toll-free verification, which HighLevel says takes four to six weeks and is not guaranteed. Submit the verification form the same day you get the number, before you plan any text campaign around it.
  • Is It Legal to Record Calls in GoHighLevel? FAQ
It depends on your state. Federal law allows recording with one party's consent, but around a dozen states require every party to agree, including California and Florida. GoHighLevel can play a recording disclaimer before a call connects, which is the practical way most businesses handle it.

FAQs

Is GoHighLevel compliant out of the box?

No single switch makes an account compliant. HighLevel provides registration flows, opt-out wording, Do Not Disturb, workflow time windows, an unsubscribe link, a DPA and an optional HIPAA package. You still decide who you contact, record consent, write the messages and handle regulated data correctly. HighLevel's own HIPAA article says accounts are not HIPAA compliant by default.

What compliance rules apply to GoHighLevel texting?

Carriers require A2P 10DLC registration for business texts from local numbers, or toll-free verification for toll-free numbers. Federal TCPA rules require prior express written consent for marketing texts that fall under them, an honored opt-out and calling hours of 8 a.m. to 9 p.m. Some states are stricter. Our state table covers 18.

Do I need A2P 10DLC if I only text a few customers?

Yes, for business texts to US numbers from a standard 10-digit local number. HighLevel says registration is required when a business sends SMS or MMS to US recipients from those numbers. Very small businesses without an EIN can use the Sole Proprietor path, which is limited to one number.

Do I need a BAA to use GoHighLevel for patients?

If you handle protected health information, yes: HighLevel's BAA comes with its HIPAA package, and your agency needs its own BAA with the practice. HHS says a business associate must have a BAA with its subcontractor before disclosing PHI to it. Ask your compliance officer to confirm the chain for your setup.

Can I record calls in GoHighLevel?

Federal law allows recording with one party's consent, but around a dozen states require everyone on the call to agree. GoHighLevel can play a disclaimer before a call connects. Which rule applies depends on where each party is. Our call recording FAQ and state table list the states we checked.

Does GoHighLevel support GDPR requirements?

It can be used in a GDPR-compliant way. HighLevel acts as processor under a DPA that is part of its terms, and you are the controller responsible for lawful basis, consent records, the cookie banner and erasure requests. Data is stored in the United States. Our GDPR FAQ lists what HighLevel provides and what you set up.

What is the penalty for breaking texting or email rules?

It varies by law. The FTC says each email violating CAN-SPAM can carry penalties of up to $53,088. Texting claims under the TCPA and state laws can be brought by consumers; our state table lists statutory amounts for the states it covers. Carriers can also filter or block your numbers. Ask counsel about your exposure.

How do I know which rule applies to me?

Start from what you do: text people, call or record calls, email people, hold health data, or serve people in the EU or UK. The decision table on this page maps each action to the rule and the guide that covers it. Where it says to ask counsel, such as marketing versus informational texts, do that.
