GoHighLevel Expert and Setup Agency in Tennessee: Builds That Follow Tennessee Law

Quick answer

A GoHighLevel expert for Tennessee businesses builds the standard account plus what Tennessee changes: a Do-Not-Call and Do-Not-Text register run by the Public Utility Commission, a new July 1, 2026 cap on prerecorded sales calls, one-party call recording backed by a felony for everyone else, and a state split between Eastern and Central time.

Updated October 14, 2026 · Reviewed by Alpit Patel, Founder

Key takeaways

  • Tennessee runs a Do-Not-Call and Do-Not-Text register under T.C.A. 65-4-401 et seq. The Public Utility Commission's program page says sellers may not call or text residential numbers on it, and lists four exceptions: express permission, a nonprofit member, a business relationship in the previous 12 months, and a non-telemarketing business making no more than three calls or texts a week.
  • Public Chapter 1029 of 2026 (House Bill 2408) took effect July 1, 2026. It adds T.C.A. 65-4-411: callers using an automatic dialer to deliver artificial or prerecorded voice messages to Tennessee residential subscribers must keep monthly counts, callers at 500 or more a month must file them with the Commission every six months starting October 1, 2026, and no one may make more than 10,000 such calls a month.
  • Tennessee is a one-party consent state for recording. T.C.A. 39-13-601(b)(5) permits interception by a party to the call or with a party's prior consent, unless the purpose is a crime or tort. Interception outside that exception is a Class D felony under 39-13-602.
  • The Tennessee Information Protection Act has been in force since July 1, 2025, but it applies only to businesses with more than $25 million in revenue that also meet a consumer-count test. Most small Tennessee businesses are outside it.
  • 49 CFR 71.5(d) puts the Eastern and Central boundary through Scott, Morgan, Roane, Rhea and Hamilton counties. Knoxville and Chattanooga run on Eastern time and Nashville and Memphis on Central, so one sub-account clock is wrong for part of the state.

Tennessee lets a business record its own phone calls, yet it also keeps a Do-Not-Text register, caps automated prerecorded sales calls at 10,000 a month from July 1, 2026, and sits on both sides of the Eastern and Central time line. A GoHighLevel expert working for a Tennessee business has to turn each of those into a setting before the first campaign goes out.

What is the Tennessee Do-Not-Call and Do-Not-Text register?

It is a list of Tennessee residential numbers, landline and cell, that the Public Utility Commission maintains under T.C.A. 65-4-401 et seq. According to the Commission’s Do-Not-Call / Do-Not-Text program page, telephone solicitors may not call or text a number on the register to sell consumer goods or services, and business numbers may not be listed.

The same page lists four situations where a solicitor may still reach a listed number:

  1. The person gave an express invitation or permission.
  2. A member of a not-for-profit organization is calling or texting on its behalf.
  3. The caller has had a business relationship with the person within the previous 12 months.
  4. The business does not sell by telephone solicitation and makes no more than three calls or texts in one calendar week.

Political calls are outside the program. The definitions in T.C.A. 65-4-401 (as reproduced by FindLaw, whose codes may lag the official text) define a telephone solicitation as a voice communication, and give a separate definition of a text message solicitation in subsection (7) with parallel exclusions. That separate text definition is why a Tennessee text campaign cannot be treated as outside the state law.

The Commission’s rules for solicitors, chapter 1220-04-11 (the version dated 2010 was the one we could open), add registration and timing duties: an annual application and fee due by May 1 covering July 1 through June 30, with the standard solicitor fee at $500, a state register updated at the start of each month, and enrollment taking effect 60 days after the month a consumer signs up. Treat those figures as a starting point and check the Commission for the current fee and form. T.C.A. 65-4-405 lets the Commission seek a civil penalty of up to $2,000 for each knowing violation.

What changes in the build

Tennessee rule Source HighLevel setting it drives
Do not call or text residential numbers on the state register T.C.A. 65-4-401 et seq. Scrub imported lists against the register before any dialer or SMS campaign; store the scrub date on the contact

What is the 2026 limit on prerecorded sales calls?

Public Chapter 1029 of 2026 (House Bill 2408) is the newest Tennessee change, and it hits voice features. The enrolled act adds a section, T.C.A. 65-4-411, and applies to conduct on or after July 1, 2026. It covers telephone solicitations by automatic telephone dialing system that deliver artificial or prerecorded voice messages to residential subscribers in Tennessee. In the act as I read it:

  • A caller keeps a monthly count of those solicitations.
  • A caller making at least 500 a month gives copies of the records to the Commission at least every six months, starting October 1, 2026, and produces them on request from the Commission or the Attorney General and Reporter.
  • No one may make more than 10,000 such solicitations a month in Tennessee, and going over is an unfair or deceptive act under the Tennessee Consumer Protection Act of 1977 with a civil penalty of at least $1,000 per violation.

Two cautions. Early commentary described the bill differently as introduced, so rely on the enrolled text above. And the act’s wording is about dialer-delivered artificial or prerecorded voice, not a business’s live reps or texts. Whether a particular ringless voicemail or AI voice agent falls inside it is a question for your attorney. Our build counts every such send by month so the numbers exist if anyone asks.

The older T.C.A. 47-18-1526, as reproduced by FindLaw, adds two duties for unsolicited sales calls to residential, mobile or paging numbers: keep a do-not-call list that meets the federal rules, and do not block caller ID. It sets a Class A misdemeanor with a fine of up to $2,500 for the caller ID violation, lets the Attorney General seek civil penalties of up to $1,000 per violation, and offers a defense for reasonable practices and procedures. A written call and text policy in the account is the evidence that defense depends on. Our power dialer FAQ explains where the dialer’s controls sit.

Yes, if you are on the call or a party has consented. T.C.A. 39-13-601(a)(1) bars intentional interception of wire, oral or electronic communications, and subsection (b)(5) makes it lawful for a person not acting under color of law to intercept when they are a party, or have a party’s prior consent, unless the purpose is a criminal or tortious act. A violation of subsection (a) is a Class D felony under 39-13-602. I could not open the civil remedy section, 39-13-603, so I do not state damages here.

In HighLevel that means:

  1. Call recording can be on for calls your team or AI agent take part in.
  2. A short notice still plays at the start, because Tennessee callers often reach contacts in other states, and some states require every party’s consent. See our recording FAQ and the state-by-state research.
  3. Listen-in and whisper stays limited to managers who are part of your call policy; a silent third party who is not a participant is the case the felony targets.

Georgia, which borders the state, takes a different view on telemarketing liability; see our Georgia page.

Does the Tennessee Information Protection Act reach a CRM?

Only for large businesses. The enrolled Public Chapter 408, effective July 1, 2025, applies to persons doing business in Tennessee that exceed $25 million in revenue and either control or process data on at least 175,000 consumers in a calendar year, or on at least 25,000 consumers while deriving over 50 percent of gross revenue from selling personal information. There is no separate small-business carve-out because the revenue floor does that job. Exempt entities include state and local government, financial institutions, insurers, HIPAA covered entities, nonprofits and higher education.

For a company that is covered, the Attorney General has exclusive enforcement authority, must give 60 days’ written notice and a chance to cure, and may seek civil penalties of up to $7,500 per violation. A written privacy program that conforms to the NIST privacy framework is an affirmative defense. In GoHighLevel the pieces are a privacy policy link on every form, a documented way to delete or export a contact, and a record of which workflows sell or share data for advertising. For most Tennessee small businesses none of this is required, but the same hygiene helps in other states where thresholds are lower.

Which Tennessee counties are on Eastern time?

The federal boundary description in 49 CFR 71.5(d) runs from the Kentucky line along the west line of Scott County, then along the north and west lines of Morgan County and the north line of Roane County to the north line of Rhea County, then along the west lines of Rhea and Hamilton Counties to the Georgia line. East of that line, including Knoxville and the Chattanooga area, is Eastern. West of it, including Nashville and Memphis, is Central.

Symptom Cause Fix in GoHighLevel
A Knoxville contact gets an appointment reminder an hour early Sub-account time zone is America/Chicago and the contact has none set Capture the contact time zone from the form address or ZIP and store it on the contact
A 9 p.m. stop for texts lands at 8 p.m. local for Chattanooga contacts The workflow window uses the business location Use the contact’s own time zone in the wait step and in the send-window condition
The public booking calendar offers Nashville slots to a Johnson City visitor in the wrong zone Calendar zone is fixed Use the visitor’s detected zone and repeat it in the confirmation email

A single-location Nashville plumber may never notice this. A statewide roofer or a clinic network with offices in Memphis and Knoxville will.

Price and timeline

At the time of writing, aibrevo’s published range for a complete single-business GoHighLevel build is $500 to $4,000, white-label SaaS $4,000 to $10,000 and multi-location $4,000 to $12,000. HighLevel’s own subscription and usage fees are separate; the GoHighLevel pricing calculator estimates them and the setup cost estimator prices your build.

A tested build usually takes two to four weeks. If a Tennessee account is already running, the account health check shows whether consent, stop handling and time zones are set, and the GoHighLevel expert page explains how to vet anyone you hire. Other states we cover

Tennessee businesses selling into the Carolinas should read our North Carolina page, where the telephone solicitation law covers text messages, and into Virginia our Virginia page, which treats marketing texts as telephone solicitations. The setup agency guide covers what any state build includes.

FAQs

Is there a GoHighLevel expert or setup agency for Tennessee businesses?

Yes. aibrevo builds GoHighLevel accounts for Tennessee businesses remotely from San Francisco, with no Tennessee office. The build changes in four places: a state Do-Not-Call and Do-Not-Text register that covers texts, a 2026 monthly limit on prerecorded sales calls, a recording notice policy that fits a one-party consent state, and contact time zones, because Tennessee spans Eastern and Central. Nashville, Memphis, Knoxville and Chattanooga are served the same way.

Does Tennessee have a Do-Not-Text law?

Yes, according to the Tennessee Public Utility Commission. Its Do-Not-Call and Do-Not-Text program page, citing T.C.A. 65-4-401 et seq., says sellers of consumer goods and services may not call or text residential numbers on the register, landline or cell. Business numbers may not be listed. The register has exceptions for permission, nonprofits, recent customers and occasional calls. Confirm current rules with the Commission before you rely on a text campaign.

Is Tennessee a one-party or two-party consent state for recording calls?

One-party. T.C.A. 39-13-601(b)(5) lets a person who is a party to the communication, or who has a party's prior consent, intercept it, unless the purpose is committing a crime or tort. A business recording its own calls can do so. Callers dialing into all-party states still need everyone's consent, so a short recording notice at the start of each call is the safer default.

What is Tennessee's new limit on prerecorded sales calls?

Public Chapter 1029 of 2026 took effect July 1, 2026 and added T.C.A. 65-4-411. It applies to telephone solicitations by automatic dialer that deliver artificial or prerecorded voice messages to Tennessee residential subscribers. Callers keep monthly counts, those at 500 or more a month file them with the Commission every six months from October 1, 2026, and more than 10,000 such calls a month is barred.

What hours can a Tennessee business call or text customers?

The Public Utility Commission's rule chapter 1220-04-11, in the 2010 version we could open, bars solicitation calls to residential subscribers before 8 a.m. or after 9 p.m. in the called party's local time, unless they gave prior express permission. Whether the current rule applies the same window to texts should be confirmed with the Commission. A 9 p.m. stop applied to the contact's own time zone is the practical build.

Does the Tennessee Information Protection Act apply to my GoHighLevel account?

Probably not if you are a small business. Public Chapter 408 covers persons that exceed $25 million in revenue and either control data on at least 175,000 Tennessee consumers a year, or on 25,000 consumers while earning over half of gross revenue from selling personal information. Nonprofits are among the exempt entities. If you are near those numbers, talk to a Tennessee attorney.
