GoHighLevel Expert and Setup Agency in Massachusetts: Built for the Wiretap Act and Chapter 159C
Quick answer
A GoHighLevel expert for Massachusetts businesses builds the standard account plus what Massachusetts changes: call recording needs everyone's prior authority, unsolicited sales calls stop at 8 p.m., telephone solicitors register with the state each year, and recurring-charge offers follow the Attorney General's 2025 rules.
Key takeaways
- Massachusetts treats secretly recording a phone call as unlawful interception unless every party gave prior authority (M.G.L. c. 272, s. 99). A call recording notice at the start of every recorded GoHighLevel call is the safe default, not an optional extra.
- Under M.G.L. c. 159C, unsolicited sales calls to Massachusetts consumers cannot be received between 8 p.m. and 8 a.m. local time, and cannot go to numbers on the state's quarterly no-sales-solicitation listing. The state's own cutoff is an hour earlier than the federal 9 p.m.
- Telephone solicitors doing business in Massachusetts must register with the state by January 1 each year (201 CMR 12.04). A consumer who gets more than one unsolicited call in 12 months can sue for the greater of actual loss or up to $5,000 (c. 159C, s. 8).
- Chapter 159C and its regulation do not name text messages. The federal TCPA does cover texts, so the build uses consent and opt-out records for SMS rather than relying on a gap in the state law.
- Since September 2, 2025, the Attorney General's 940 CMR 38.00 sets rules for free trials and automatic renewals: written disclosure up front, a cancellation method as easy as sign-up, and for terms over 31 days a written reminder 5 to 30 days before the deadline.
In Massachusetts, switching on GoHighLevel call recording without telling the caller can be punished by up to five years in prison, and an unsolicited sales call received after 8 p.m. is already unlawful, an hour before the federal cutoff. A GoHighLevel expert building for a Massachusetts business therefore sets up the phone system, call windows and checkout terms around those rules first, then adds the pipelines and workflows. Telephone solicitors also register with the state each year, and free-trial and auto-renewal offers have had Attorney General rules since September 2025.

Recording calls in Massachusetts: the rule that catches out out-of-state teams
Many CRM builders assume a US state is either one-party or all-party consent and move on. Massachusetts is the clearest case where the answer decides how a GoHighLevel phone system is configured.
M.G.L. c. 272, s. 99 defines “interception” as to “secretly hear, secretly record, or aid another to secretly hear or secretly record” the contents of a communication using a device, by anyone other than a person given prior authority by all parties. The key word is “secretly.” A call that the other person has been told about, and continues, is not secretly recorded; one that nobody mentioned is. The consequences are not small:
- Criminal: willful interception is punishable by a fine of up to $10,000, imprisonment of up to five years, or both (paragraph C).
- Civil: the person recorded can sue for actual damages, with a floor of liquidated damages at $100 per day of violation or $1,000, whichever is higher, plus punitive damages and attorney’s fees (paragraph Q).
So the build handles recording as follows:
- Recording notice on every recorded call. An inbound greeting or call-flow message tells the caller the call may be recorded, before anything else is said. Outbound reps open with the same line, and the line is scripted in the dialer.
- Recording off by default for new numbers. Recording is turned on only for numbers that have the notice in place, so a new number cannot record before the notice is configured.
- AI voice and voicemail. Any AI voice agent or call transcription feature gets the same disclosure at the start of the call.
- Out-of-state callers. A Massachusetts contact called by a rep elsewhere is still protected by this statute, so the notice is not tied to where your team sits.
Our call recording FAQ covers the state-by-state picture. The statute has exemptions (paragraph D), for example for telephone carriers and certain financial-institution trading calls, but none for an ordinary business recording a customer call.

Chapter 159C: what an unsolicited sales call is, and what is outside it
M.G.L. c. 159C is the Massachusetts telemarketing statute, with the Do Not Call Registry rules in 201 CMR 12.00. Three definitions decide who is affected:
- Consumer means an individual who is a Massachusetts resident and a prospective recipient of consumer goods or services. Business numbers are excluded from the registry (201 CMR 12.05(6)).
- Unsolicited telephonic sales call excludes a call made in response to the consumer’s express written or verbal request, a call to an existing customer (an account or business relationship within the previous 24 months) unless the customer has said they no longer want calls, and calls about an existing debt or contract.
- Telephone solicitor is any business doing business in Massachusetts that makes or causes a sales call, including from outside the state to Massachusetts consumers.
For GoHighLevel, the first two matter most. A form submission where the lead agrees to be contacted is a request, and an existing customer can be called, so the build records which basis applies to each contact: a tag for the form, the consent text and the date, or the last purchase date. A purchased or scraped consumer list has neither, which is where the quarterly registry scrub and the 8 p.m. cutoff apply.
The settings that follow from it:
- Call windows end at 8 p.m. in the contact’s time zone, not the account’s. A Boston office calling a contact in another zone is judged by where the consumer is.
- Do-not-call handling: a “do not call” tag plus DND on voice and SMS, applied from the conversation view when a contact says to stop.
- Registry scrub: solicitors must use the most recent registry (201 CMR 12.04(3)). The registry is available to registered solicitors, so scrubbing is a step before a campaign starts, not an automatic GoHighLevel feature.
- Opening script: within the first minute, the rep states that the purpose is a sale, the company and ultimate seller, and a description of the goods or services (201 CMR 12.02(7)).
Are text messages covered by Chapter 159C?
The sources do not say. The definition of marketing in 201 CMR 12.01 covers “the initiation of a telephone call or message,” but neither the statute nor the regulation names text messages, and no court ruling applying them to texts turned up. We therefore do not treat texts as outside the rules. The federal Telephone Consumer Protection Act applies to texts, and a federal court in Boston held that it covers text messages to a number on the national registry (Sagar v. Kelly Automotive Group, D. Mass. 2021, summarized in Mass.gov’s telemarketing guide). The SMS build is the same one used everywhere: a separate marketing-text checkbox on each form, STOP honored automatically, and A2P 10DLC opt-in wording that matches the forms. See our guide to A2P rejections.
What a violation costs
| Who acts | Remedy under c. 159C, s. 8 |
|---|---|
| Attorney General | Civil penalty of not more than $5,000 per knowing violation; at least $1,500 where a knowing violation involves a consumer 65 or older |
| A consumer who received more than one unsolicited call in 12 months from the same caller | Injunction, plus actual monetary loss from a knowing violation or up to $5,000, whichever is greater |
| The prevailing party in a civil case | Reasonable attorney’s fees and costs from the other side |
The private claim is what makes consent records matter. The statute also gives a defense in section 9; read it with a Massachusetts attorney rather than relying on it.
Free trials, memberships and auto-renewals
If you sell a membership, subscription or free-trial offer from a GoHighLevel funnel, the Attorney General’s 940 CMR 38.00 applies to acts and practices from September 2, 2025 (38.09). Its purpose is protection of people buying for personal, family or household use, so check whether it reaches your offer. Where it does, 38.05 sets out:
- Before the sale: written, clear and conspicuous disclosure that the buyer will be charged, whether charges recur, and how to cancel. For a trial, the date charges begin.
- Cancellation: at least as easy as signing up, and in the same medium. An online sign-up needs an online cancellation.
- Terms over 31 days: a written notice 5 to 30 calendar days before the cancellation deadline.
- Total price: 38.04 requires the total price, with fees, to be disclosed clearly at the first price presentation and at checkout.
A violation is an unfair and deceptive practice under G.L. c. 93A. The build adds a plain-language disclosure block above each checkout button, a self-serve cancel page, and a reminder workflow scheduled from the trial or renewal date. Our membership site guide covers the mechanics.
Where Massachusetts accounts go wrong: symptom, cause, fix
| Symptom | Likely cause in GoHighLevel | Fix |
|---|---|---|
| A rep records a call and the caller was never told | Recording turned on at the number level with no greeting | Notice before recording; script line for outbound calls |
| Outbound campaign calls reach contacts after 8 p.m. | Window set in the account’s time zone, with contacts in another | Window evaluated in the contact’s time zone, ending by 8 p.m. |
| A consumer says they asked to stop and gets another call | Stop request logged in notes, not as DND or tag | DND on voice and SMS plus a do-not-call tag, set from the conversation |
| Voice drops go to cold consumer numbers | Drop step inside a general nurture workflow | Drops only to contacts tagged with recorded consent |
| A trial converts to paid with no notice | No reminder workflow tied to the trial date | Reminder workflow 5 to 30 days before the deadline for terms over 31 days |
Time zone and the rest of the account
Massachusetts is on Eastern time with daylight saving, so the sub-account and calendars use America/New_York. The mistake to avoid is cloning a snapshot built for another zone: a calendar left on Pacific time shows slots three hours off, and a 9 a.m. reminder fires at noon. The 8 p.m. call cutoff is measured where the consumer is, so contacts outside Eastern time carry their own zone.

Price and timeline
Our published range for a complete single-business GoHighLevel build is $500 to $4,000, white-label SaaS $4,000 to $10,000 and multi-location $4,000 to $12,000, at the time of writing. HighLevel’s own subscription and usage fees are separate; the GoHighLevel pricing calculator estimates them, and the setup cost estimator prices your build. Any state registration fee, if you need one, is paid to the state.
A tested build usually takes two to four weeks. The GoHighLevel expert page explains how to vet anyone you hire, including us, and the account health check is a quick way to see whether an existing Massachusetts account already has the recording notice and call-window settings in place.
Other states we cover
Massachusetts companies that call or text contacts in New York should read our New York page, and those dialing Pennsylvania should read our Pennsylvania page, because each state has its own recording and solicitation rules and the stricter one usually decides the setting.
